This article states that, with his narrative, the author of Daniel 6 creates the presence of Elohim outside Jerusalem and Israel, within non-Israelite environments. Applying a body-space frameset to the texts of Daniel 6 helps to read the text as a construction of concepts. With his narrative the author creates the presence of Elohim outside Jerusalem and Israel, within non-Israelite environments. Furthermore, a spatial frameset shows that the story of Daniel 6 can be read as a conclusion to a larger (...) narrative that stretches from Daniel 1–6. In this narrative the author utilises spatial concepts such as the character of Daniel; the lion’s den; Jerusalem and King Darius, to establish the omnipresence of the God of Israel. In constructing this presence of-God reality the author conveys a message of hope and trust in the authority of the God of Israel. In this regard Daniel 6 is not just a story about the character Daniel being persecuted for his faith; rather it is a story about the God of Israel establishing his presence and his ability to act through and within space and time. This article examines the role of philosophy in the development of the kinetic theory of gases. Two opposing accounts of this role, by Peter Clark and John Nyhof, are discussed and criticized. Contrary to both accounts, it is argued that philosophical views of scientists can fundamentally influence the results of their scientific work. This claim is supported by a detailed analysis of the philosophical views of Maxwell and Boltzmann, and of their work on the kinetic theory, especially concerning the so-called (...) specific heat anomaly. It leads to the conclusion that the scientific development of the kinetic theory cannot be understood without taking into account the role of philosophy. (shrink)

In this paper I argue against the received view that the anti-nativist arguments of Book I of Locke’s Essay conclusively challenge nativism. I begin by reconstructing the chief argument of Book I and its corollary arguments. I call attention to their dependence on (what I label) “the Awareness Principle”, viz., the view that there are no ideas in the mind of which the mind either isn’t currently aware or hasn’t been aware in the past. I then argue that the arguments’ (...) dependence on this principle is question begging on two counts. Unless this principle is defended, Locke’s arguments beg the question against Descartes and Leibniz because their nativism implies the denial of the Awareness Principle. And even when Locke defended the principle, his arguments remain question begging because they presuppose the empiricism they aim to prove. The disclosure of the question-begging status of these arguments debunks a seemingly powerful way of attacking nativism. (shrink)

The goal of the present paper is to assess Hans Vaihinger’s understanding of the notion of the given in Die Philosophie des Als Ob. The claim will be advanced that the overall framework of Vaihinger’s theory of knowledge and, more specifically, his understanding of both the given and fictions should be sought for in the manner in which R. Hermann Lotze assesses the problem of knowledge, namely, the relation between thought and being in both his early and late Logik. As (...) we will argue, the way in which Vaihinger recasts the opposition between what is given objectively (data of sensations) and what is added subjectively is to be deemed a direct radicalization of Lotze’s own stance. As the conclusion will further add, what is at stake inVaihinger’s fictionalism is a quite specific understanding of the ideas of reason and transcendental philosophy. (shrink)

The arguments advanced here are partially based on the view that a core feature of Darwinism is that it stresses the environmental relativity of functions and dysfunctions. These arguments show a very close empirical connection between social judgments and dysfunctions, which is of interest for psychiatric theory. Philosophically, they lead to the conclusion that the concept of mental disorder is identical to the concept of mental dysfunction. Background: This article describes the overall attitudes of children, their parents, and attending physicians toward including or excluding pediatric patients in medical communication and health care decision-making processes. Methods: Fifty-two interviews were carried out with pediatric patients (n = 17), their parents (n = 19), and attending oncologists (n = 16) in eight Swiss pediatric oncology centers. The interviews were analyzed using thematic coding. Results: Parenting styles, the child's personality, and maturity are factors that have a great impact upon the (...) inclusion of children in their health care processes. Children reported the desire to be heard and involved, but they did not want to dominate the decision-making process. Ensuring trust in the parent–child and physician–patient relationships and respecting the child as the affected person were important values determining children's involvement. These two considerations were closely connected with the concern that fantasies are often worse than reality. Seeking children's compliance with treatment was a practical but critical reason for informing them about their health care. The urge to protect them from upsetting news sometimes resulted in their (partial) exclusion. Conclusions: The ethical imperative for inclusion of children in their health care choices was not so much determined by the right for self-determination, but by the need to include them. If children are excluded, they imagine things, become more isolated, and are left alone with their fears. Nevertheless, the urge to protect children is innate, as adults often underestimate children's coping capacities. (shrink)

Objective To assess whether the frequency of end-of-life decisions for children under 1 year of age in the Netherlands has changed since ultrasound examination around 20 weeks of gestation became routine in 2007 and after a legal provision for deliberately ending the life of a newborn was set up that same year. Methodology This was a recurrent nationwide cross-sectional study in the Netherlands. In 2010, a sample of death certificates from children under 1 year of age was derived from the (...) central death registry. All 223 deaths that occurred in a 4-month study period were included. Physicians who had reported a non-sudden death (n=206) were sent a questionnaire on the end-of-life decisions made. 160 questionnaires were returned (response 78%). Findings In 2010, 63% of all deaths of children under 1 year of age were preceded by an end-of-life decision—a percentage comparable to other times when this study was conducted (1995, 2001, 2005). These end-of-life decisions were mainly decisions to withdraw or withhold potentially life-sustaining treatment. In 2010, the percentage of cases in which drugs were administered with the explicit intention to hasten death was 1%, while in 1995 and 2001, this was 9% and in 2005, this was 8%. Discussion and conclusion There has been a reduction of infant deaths that followed administration of drugs with the explicit intention to hasten death. One explanation for this reduction relates to the introduction of routine ultrasound examination around 20 weeks of gestation. In addition, the introduction of legal criteria and a review process for deliberately ending the life of a newborn may have left Dutch physicians with less room to hasten death. (shrink)

This article discusses Hilary Putnam's views on the mind-body problem, by locating them in the general context of a satisfying pluralistic naturalism that he tried to articulate throughout his entire philosophical career. The first attempt in this direction was computational functionalism, his version of psychological functionalism centered on the analogy between mind/body and software/hardware, which (differently from David Lewis and others) he came to think of as an empirical hypothesis. That was a very successful proposal; however, later Putnam abandoned it (...) and embraced what he called 'liberal functionalism'. The reason for this change of mind was twofold: on the one hand, Putnam reached the conclusion that computational functionalism was incompatible with his views on semantic externalism; on the other hand, he began to think that mental states, besides being compositionally plastic (i.e., two entities can be in the same psychological state without being in the same physical state), are also computationally plastic (i.e., two entities can be in the same psychological state without being in the same functional state).In conclusion, I will argue that 'liberal functionalism' opened an interesting perspective for a successful non-reductive version of naturalism. Ecological science has been viewed by some philosophers as a foundational resource for the development of metaphysical, epistemological and normative views concerning humanity’s relationship with the natural environment, or what might be called an “ecological philosophy.” Analysis of three attempts to infer philosophical conclusions from ecological science shows that there are serious obstacles facing any attempt to derive unique philosophical consequences from ecological science and the project of developing an ecological philosophy relevant to human-environment relations is seriously hindered by (...) a reliance on traditional ecological science that focuses on relations between nonhuman organisms and their environments. However, the search for an ecological philosophy is not inherently misguided because although ecological science may never support a unique philosophical interpretation of ecological theory, empirical evidence can function to narrow the range of possible interpretations, which is a significant epistemic achievement; and because there are several non-traditional branches of ecological science that focus on human-environment relations and that consequently may be better suited to function as conceptual resources for the sorts of problems that concern environmental philosophers. In Chapter II of his work The Philosophy of Spinoza, Wolfson accepts Descartes' distinction between the geometrical method of philosophizing and the geometrical form of literary exposition. The geometrical method of philosophizing is a method of demonstration and is essentially identical with “valid syllogistic reasoning as practised throughout the history of philosophy.” The geometrical form of literary exposition is one modelled after the literary form of Euclid's Elements. Wolfson proceeds to present two theses which serve as the premises of a (...) conclusion respecting the relation between form and content in Spinoza's Ethics. The first thesis is that as a consequence of Spinoza's “mathematical way of looking at things” the geometrical method “is adopted by Spinoza and used consistently in his discussions of metaphysical matters throughout his chief philosophic work.” The second thesis is to the effect that there is no logical connection between the geometrical method of philosophizing and the geometrical literary form of exposition, i.e., a geometrizing philosopher, e.g., Descartes, need not employ the geometrical literary form. From these theses, serving as premises, Wolfson concludes that “there is no logical connection between the substance of Spinoza's philosophy and the form in which it is written” and, hence, “his choice of the Euclidian geometrical form is to be explained on other grounds.” Wolfson proceeds to present four possible reasons which, either individually or conjointly, may lie behind Spinoza's employment of the geometrical literary form: on pedagogical grounds, in reaction against certain literary forms which had developed since the Renaissance, to avoid arguing against his opponents, and for the sake of novelty. La Didáctica General es la disciplina pedagógica que estudia la enseñanza para el conocimiento y la formación, a través de la comunicación educativa. Los manuales y textos de referencia de la disciplina no suelen reparar en temáticas radicales, esto es, esenciales para la educación y no demandadas. Una de ellas es la dualidad en marcos didácticos, entendida en nuestro contexto como un hábito de la razón humana que, bien perjudica, bien dificulta la evolución personal, social y educativa. El objetivo es (...) triple: por un lado, avanzar en la definición de la dualidad como un problema formativo que incide directamente en la enseñanza, el aprendizaje y la formación o deformación relativa. Por otro, es indagar en fundamentos aplicables, prácticos, de una enseñanza educadora que lo afronte en el proceso evolutivo del ego a la conciencia. El tercero es contribuir al salto en el reconocimiento epistemológico de un problema desatendido o ignorado a un asunto de primera magnitud pedagógica. La metodología es el ensayo pedagógico, realizado desde el enfoque radical e inclusivo aplicado, en esta ocasión, a constructos claves de la Didáctica General. Los resultados se desprenden desde el principio y durante todo el proceso, desde contenidos organizados en epígrafes sucesivos que pueden ser centros de interés didácticos y educativos. La conclusión más importante es que la superación de dualidades puede ser un camino válido para una enseñanza orientada a una formación con base en la conciencia, en cualquier contexto didáctico, informal o formal. Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. The conclusions drawn by Benjamin Libet from his work with collegues on the timing of somatosensorial conscious experiences has met with a lot of praise and criticism. In this issue we find three examples of the latter. Here I attempt to place the divide between the two opponent camps in a broader perspective by analyzing the question of the relation between physical timing, neural timing, and experiential timing. The nervous system does a sophisticated job of recombining and recoding messages (...) from the sensorial surfaces and if these processes are slighted in a theory, it might become necessary to postulate weird operations, including subjective back-referral. Neuroscientifically inspired theories are of necessity still based on guesses, extrapolations, and philosophically dubious manners of speech. They often assume some neural correlate of consciousness as a part of the nervous system that transforms neural activity in reportable experiences. The majority of neuroscientists appear to assume that the NCC can compare and bind activity patterns only if they arrive simultaneously at the NCC. This leads to a search for synchrony or to theories in terms of the compensation of differences in neural delays . This is the main dimension of the Libet discussion. Examples from vision research, such as “temporal-binding-by-synchrony” and the “flash-lag” effect, are then used to illustrate these reasoning patterns in more detail. Alternatively one could assume symbolic representations of time and space that are not coded in their own dimension . Unless such tags are multiplexed with the quality message , one gets a binding problem for tags. One of the hidden aspects of the discussion between Libet and opponents appears to be the following. Is the NCC smarter than the rest of the nervous system, so that it can solve the problems of local sign and timing on its own, or are these pieces of information coded symbolically early on in the system? A supersmart NCC appears to be the assumption of Libet's camp . The wish to distribute the smartness evenly across all stages of processing in the nervous system appears to motivate the opponents. G. Deledalle is the author of a Histoire de la philosophie américaine, and of some excellent studies on Dewey, such as La pédagogie de Dewey, philosophie de la continuité, and "Durkheim et Dewey". These are all works that deserve full attention by students of the Golden Age of American philosophy. For a European, Deledalle has an unusual capacity to detect the vitality and freshness, but also the depth, of the growth of higher education in the U.S. in the first half (...) of this century. At the heart of this growth were philosophical ideas, and in particular those of Dewey. Philosophy did not have then dictatorial or competitive designs regarding education, the social and political sciences, psychology, or the natural sciences. It freely mingled with them, not just imparting methodological or epistemological rigor but also contributing some insights and giving the hypotheses and conclusions in these fields the character of "experiences." Experience is the guiding theme of this rich and complicated work, covering a multitude of subjects and positions. The treatment is divided into six parts dealing respectively with Dewey's leanings toward unitary experience, organic experience, dynamic experience, functional experience, instrumental experience, and transactional experience. In the study of the intellectual of Dewey's life practically all of his production is critically examined by Deledalle: a monumental task in itself, made possible by the critical bibliography of Milton Hasley Thomas. There is enough early biographical detail to make this work an effective and affectionate intellectual portrait. The best pages of this work are devoted to a thorough explication and comparative study of Dewey's final synthesis of experience. There are very helpful comparative references to Marx, Freud, Bergson, and Heidegger, and also indispensable parallels and contrasts with Peirce, James, and Whitehead. This is not a modest contribution from a regional point of view: Deledalle is, perhaps more than anybody else, aware of an ongoing international dialogue on Dewey, a dialogue that is preserving experience as a problem-complex at the front line of contemporary reflection.--A. de L. The argument from design stands as one of the most intuitively compelling arguments for the existence of a divine Creator. Yet, for many scientists and philosophers, Hume's critique and Darwin's theory of natural selection have definitely undermined the idea that we can draw any analogy from design in artifacts to design in nature. Here, we examine empirical studies from developmental and experimental psychology to investigate the cognitive basis of the design argument. From this it becomes clear that humans spontaneously discern (...) purpose in nature. When constructed theologically and philosophically correctly, the design argument is not presented as conclusive evidence for God's existence but rather as an abductive, probabilistic argument. We examine the cognitive basis of probabilistic judgments in relationship to natural theology. Placing emphasis on how people assess improbable events, we clarify the intuitive appeal of Paley's watch analogy. We conclude that the reason why some scientists find the design argument compelling and others do not lies not in any intrinsic differences in assessing design in nature but rather in the prior probability they place on complexity being produced by chance events or by a Creator. This difference provides atheists and theists with a rational basis for disagreement. (shrink)

The traditional sporting games correspond to a set of signs full of meanings, which come to life through the motor behaviors of the players as they participate in its semiotic semantics. As a result of this exchange, interpersonal conflicts may emerge because of each person’s semiotic interpretation of the sociomotor dynamics of the game. This research aimed to analyze the comments of intense negative emotions that arise in conflicts of a praxical nature in a TSG, in its different parts, and (...) in the motor interventions of its protagonists. A total of 160 university students participated in a competitive sociomotor traditional sporting game of cooperation-opposition: the Marro. At the end of the practice, all answered the validated GES-II questionnaire. Subsequently, a content analysis of 480 comments was performed using ATLAS.ti 8.4 software. The conclusion of this work verifies the existence of different levels of meaning in the semiotic experience that originate interpersonal conflicts in traditional sporting games. Considering the multidimensional network of signs and meanings that emerge in any game will help to understand the meaning of the protagonists’ conflictive motor conducts. (shrink)

The aim of this article is to investigate the roles of commutative diagrams (CDs) in a specific mathematical domain, and to unveil the reasons underlying their effectiveness as a mathematical notation; this will be done through a case study. It will be shown that CDs do not depict spatial relations, but represent mathematical structures. CDs will be interpreted as a hybrid notation that goes beyond the traditional bipartition of mathematical representations into diagrammatic and linguistic. It will be argued that one (...) of the reasons why CDs form a good notation is that they are highly mathematically tractable: experts can obtain valid results by ‘calculating’ with CDs. These calculations, take the form of ‘diagram chases’. In order to draw inferences, experts move algebraic elements around the diagrams. It will be argued that these diagrams are dynamic. It is thanks to their dynamicity that CDs can externalize the relevant reasoning and allow experts to draw conclusions directly by manipulating them. Lastly, it will be shown that CDs play essential roles in the context of proof as well as in other phases of the mathematical enterprise, such as discovery and conjecture formation. (shrink)

It often appears that leading politicians in Belgium consider the results of the municipal elections in the light of national polities. They stick to the thesis that the municipal poll-results, at least in the bigger towns, are more and more influenced by the constellation of the nation's politics.Is it really so that the municipal elections indicate the hearings of the national political situation? Can one draw conclusions from the results of these elections as if they were national ones? And (...) can one,any how, compare municipal to parliamentary elections? By comparison of the results of municipal elections 1964 and of parliamentary elections 1965 it was checked which shifts in party-choice havehappened during this short period of eight months. If no oscillations, or only a few, were detected between both elections, one could conclude that the municipal elections 1964 indicated indeed the hearings of the parliamentary elections 1965.Successively, the national and provincial results of these elections were compared and the party-shifts on national and provincial level were calculated.To make a relevant comparison between the election-results on a lower level, a comparable basic unity had to be found. As there were no municipal data available at parliamentary elections on one side, andonly municipal results at the municipal elections on the other side, the least possible unity for which parliamentary election-results are known, the electoral canton namely, was chosen as a comparison-basis. For that purpose however the results per party had to be additioned in all municipalities belonging to one canton.Part of the electoral cantons was unfit for use as comparison-material for two reasons : the highly varied and often strongly local-coloured political party-structure on one hand, the big number of municipalitieswithout elections on the other hand. So we were bound to make a choice out of 212 electoral cantons. Finally the cantons with a maximum of 4 municipalities were chosen, which limited the number of cantons to 28. These cantons were classified by degree of urbanisation according to the typology of W. Van Waelvelde and H. Van der Haegen.In that classification the percentages of votes in favour of the political parties, at the occasion of these elections, were tabulated and compared.The participating parties and lists were grouped as much as possible around the traditional parties to which they were most related. So we distinguish in Flanders : CVP, BSP, PVV, VU, CPB and other parties ;in the Walloon region: PSC, PSB, PLP PCB, French-speaking lists and other parties.For this analysis we also thought it was relevant to control separately the shifts of the electoral corps in the Flemish, the Walloon and the Brussels cantons. These shifts were then specified according to thedegree of urbanisation.To measure the size of the party-shifts for these elections, the external election-shift standard was calculated for the chosen Flemish, Walloon and Brussels cantons, with a special attention for the degree of urbanisation. Finally we examined which attitude was assumed by the government, the governmental and the opposition parties, in relation to the results of the municipal 1964 elections.It appeared that some notable party-shifts had been realized during the short period between the municipal elections of 1964 and the legislative elections of 1965. In general, a certain polarization has taken place due to a centrifugal vote-shift to the left and still more to the right. The direction of vote-shifts, which had shown at the municipal elections of 1964, was affirmed at the legislative elections of 1965 and for some parties, CVP and PVV namely, it was even accentuated. The parallelism between both elections in relation to the direction of the vote-shifts did not mean however that the size of these shifts was the same everywhere. The image of the shifts was different according to linguistic region and degree of urbanisation.The analysis of the urbanisation-degree showed that the level of oscillations grew higher as the urbanisation-degree grew lower. Seen per linguistic region, the largest shifts had taken place in the Walloon cantons. According to the calculations of the electoral shift standards during the period 1964-1965, the lowest oscillations were noted in the Flemish and Brussels cantons, i.e. the voting-behaviour of the big agglomerations during the municipal elections of 1964 were the closest to the national electoral pattern. Seen that way they were, up to a certain degree, a value-measure for the general policy.Finally the remark should be made that the limitation to the two above-mentioned elections does not allow any generalization of the obtained conclusions. The short period between those elections was itself an exceptional situation which may have been of influence on the results of the comparisons. (shrink)

Practical wisdom eliminativism has recently been proposed in both philosophy and psychology, on the grounds of the alleged redundancy of practical wisdom (Miller 2021 ) and its purported developmental/psychological implausibility (Lapsley 2021 ). Here we respond to these challenges by drawing on an improved version of a view of practical wisdom, the “Aretai model”, that we have presented elsewhere (De Caro et al. 2021 ; Vaccarezza et al. 2023 ; De Caro et al. forthcoming ). According to this model, practical (...) wisdom is conceptualized: (i) as virtuousness _tout court_, i.e., as the _ratio essendi_ of the virtues, and (ii) as a form of ethical expertise. By appealing to the first thesis, we counter the charge of psychological implausibility, while we rely on the second thesis to address the accusation of redundancy. In conclusion we argue that the Aretai model implies a significant paradigm shift in virtue ethics. Practical wisdom emerges as both necessary and sufficient for virtuousness, thereby downsizing – without eliminating entirely – the role that individual virtues play in our ethical lives. (shrink)

I argue that scientific knowledge is collective knowledge, in a sense to be specified and defended. I first consider some existing proposals for construing collective knowledge and argue that they are unsatisfactory, at least for scientific knowledge as we encounter it in actual scientific practice. Then I introduce an alternative conception of collective knowledge, on which knowledge is collective if there is a strong form of mutual epistemic dependence among scientists, which makes it so that satisfaction of the justification condition (...) on knowledge ineliminably requires a collective. Next, I show how features of contemporary science support the conclusion that scientific knowledge is collective knowledge in this sense. Finally, I consider implications of my proposal and defend it against objections. (shrink)

Réexamen d'une statuette trouvée en 1946 dans le dépôt sacré de l'Artémision. Les statuettes trouvées en Egée datent, semble-t-il, de la dernière époque mycénienne (HR III B-C). C'est de la côte syro-palestinienne que leur type a été introduit dans le monde créto-mycénien, via Chypre. Très nombreuses en Orient,· elles sont exceptionnelles en Egée, où elles sont étrangères à l'iconographie. Dans leurs pays d'origine, ce sont des effigies divines et il est vraisemblable qu'elles ont conservé cette signification en Egée. Le bronze (...) de Délos représente, comme les autres, une divinité et date d'environ 1200 ou du XIIe s. Conclusions : 1) Présence d'une idole (masculine) à l'Artémision ; 2) Cette présence n'est pas incompatible avec celle d'une divinité féminine prééminente ; 3) La notion de continuité des cultes est renforcée ; 4) Les récentes études mettent en valeur la diversité des cultes et des symboles et incitent à distinguer des variantes locales en fonction de chaque sanctuaire à la fin de l'âge du Bronze en Egée. Purpose The purpose of this paper is to develop an ethical framework for the marketing of corporate social responsibility. Methods The approach is a conceptual one based on virtue ethics and on the corporate identity literature. Furthermore, empirical research results are used to describe the opportunities and pitfalls of using marketing communication tools in the strategy of building a virtuous corporate brand. Results/conclusions An ethical framework that addresses the paradoxical relation between the consequentialist perspective many proponents of the marketing (...) of CSR adopt, and ethical perspectives which criticize an exclusive profit-oriented approach to CSR. Furthermore, three CSR strategies in relation to the marketing of CSR are discussed. For each CSR strategy it is explored how a corporation could avoid falling into the promise/performance gap. Although the basis of modern biology is Cartesian, Descartes’s theories of biology have been more often ridiculed than studied. Yet, Dennis Des Chene demonstrates, the themes, arguments, and vocabulary of his mechanistic biology pervade the writings of many seventeenth-century authors. In his illuminating account of Cartesian physiology in its historical context, Des Chene focuses on the philosopher’s innovative reworking of that field, including the nature of life, the problem of generation, and the concepts of health and illness. Futsal is a sport that presents alternation of high- and low-intensity moments, which lacks investigations regarding the effects of the organization of the training load on biomotor skills. In this sense, this study aims to verify the monitoring of the training load throughout the season and the behavior of biomotor skills in futsal athletes. Twelve futsal athletes from the adult category, who competed in the first division of the Paulista championship, participated in the study. Throughout the season, the internal training (...) load was calculated, through the relationship between volume and the rate of perceived exertion, monotony, and training strain. The training periods were divided into preparatory, competitive, and competitive II for a total of four moments of evaluation: M1: at the beginning of the preparatory period; M2: 50 week, at the end of the preparatory period; M3: 13th week, in the middle of the competitive period; and M4: at the start of the competitive period II. The tests used were: Power of lower limbs: countermovement jump ; Displacement speed, over the 10-meter distance, and Aerobic power by the Carminatti test. The variables analyzed were compared at different moments of evaluation using the two-way ANOVA completed by the Bonferroni test. For monotony, training strain, and ILT, the ANOVA ONE-WAY test was used between the evaluation periods completed by the Bonferroni test. The significance value adopted was p < 0.05. A significant improvement was observed in the power of lower limbs from M1 to M3, from M2 to M3, and from M1 to M4. Aerobic power showed a significant increase from M1 to M3 and from M1 to M4. The ITL showed a difference between competitive I and II in relation to the preparatory period. In conclusion, the proposed training organization was sufficient to improve the power of the lower limbs and the aerobic power. (shrink)

Resumen Este trabajo consiste en un análisis histórico de textos que proceden de un expediente archivístico de Cartagena de Indias entre 1715 y 1717. Los autos son textos administrativos que poseen diversas funciones en las relaciones institucionales entre metrópoli y colonias, tal como la de “emitir opinión”. En la tipología textual indiana, esta función se denomina consulta o parecer, y se caracteriza por el uso de un predicado de tipo doxástico. Para el análisis hemos adoptado las perspectivas teóricas del análisis (...) histórico del discurso y de la sociopragmática histórica. El estudio se completa con un análisis cuantitativo que permite resaltar cuáles son los rasgos lingüísticos a los que se vincula la intensificación y la atenuación en el subtipo debate dentro del registro legal en el español de la Cartagena del siglo XVIII. La conclusión sugiere que los recursos lingüísticos encontrados aumenta la intención persuasiva de la argumentación característica de los autos cartagineses. (shrink)

There is good reason to think that moral responsibility as accountability is tied to the violation of moral demands. This lends intuitive support to Type-Symmetry in the collective realm: A type of responsibility entails the violation or unfulfillment of the same type of all-things-considered duty. For example, collective responsibility necessarily entails the violation of a collective duty. But Type-Symmetry is false. In this paper I argue that a non-agential group can be collectively responsible without thereby violating a collective duty. To (...) show this I distinguish between four types of responsibility and duty in collective contexts: corporate, distributed, collective, shared. I set out two cases: one involves a non-reductive collective action that constitutes irreducible wrongdoing, the other involves a non-divisible consequence. I show that the violation of individual or shared duties both can lead to irreducible wrongdoing for which only the group is responsible. Finally, I explain why this conclusion does not upset any work on individual responsibility. (shrink)

Este trabajo intenta analizar las tensiones e interrelaciones entre el paradigma del reconocimiento y el paradigma de la redistribución. En concreto se analiza críticamente la obra de Nancy Frazer. En este sentido, se propone el paradigma de la inclusión, para un tercer ámbito, el de la política. Este paradigma se basaría en el ideal de la igual dignidad y la tricotomía inclusión/exclusión/participación. También se plantean reservas a la noción de paridad participativa, que según Fraser, hace conmensurables todas las demandas de (...) justicia. La conclusión es que redistribución y reconocimiento son irreductibles, están interrelacionados y en tensión. Para los casos de soluciones contrapuestas, se propone la noción de inconmensurabilidad que sostienen los defensores del pluralismo de valores -Berlin,Gray-. En casos de conflicto, redistribución y reconocimiento abocarían a una respuesta similar a cómo se debería resolver un dilema. (shrink)

On Carlos Moya's Reply to the Argument from Luck Resumen: Esta nota crítica se centra en el argumento de Carlos Moya a favor de la conclusión de que el Argumento de la Suerte representa en realidad un problema mayor para los compatibilistas que para los libertaristas. La Sección 1 introduce brevemente el Argumento de la Suerte. La Sección 2 discute la distinción de Moya entre dos concepciones de deliberación práctica, y propone una manera alternativa a la de Moya de entender (...) la crítica al libertarismo que se basa en la condición de que cualquier decisión libre debe tener una explicación contrastiva. Finalmente, la Sección 3 resume la respuesta libertarista de Moya al Argumento de la Suerte, y sugiere un modelo alternativo de determinismo que Moya podría considerar para completar su argumento. There is a relatively recent trend in treating negation as a modal operator. One such reason is that doing so provides a uniform semantics for the negations of a wide variety of logics and arguably speaks to a longstanding challenge of Quine put to non-classical logics. One might be tempted to draw the conclusion that negation is a modal operator, a claim Francesco Berto, 761–793, 2015) defends at length in a recent paper. According to one such modal account, the negation (...) of a sentence is true at a world x just in case all the worlds at which the sentence is true are incompatible with x. Incompatibility is taken to be the key notion in the account, and what minimal properties a negation has comes down to which minimal conditions incompatibility satisfies. Our aims in this paper are twofold. First, we wish to point out problems for the modal account that make us question its tenability on a fundamental level. Second, in its place we propose an alternative, non-modal, account of negation as a contradictory-forming operator that we argue is superior to, and more natural than, the modal account. (shrink)

Background There has been little attention paid to research on the outcomes of clinical ethics support or critical reflection on what constitutes a good CES outcome. Understanding how CES users perceive the importance of CES outcomes can contribute to a better understanding, use of and normative reflection on CES outcomes. Objective To describe the perceptions of Dutch healthcare professionals on important outcomes of moral case deliberation, prior to MCD participation, and to compare results between respondents. Methods This mixed-methods study used (...) both the Euro-MCD instrument and semi-structured interviews. Healthcare professionals who were about to implement MCD were recruited from nursing homes, hospitals, psychiatry and mentally disabled care institutions. Results 331 healthcare professionals completed the Euro-MCD instrument, 13 healthcare professionals were interviewed. The outcomes perceived as most important were ‘more open communication’, ‘better mutual understanding’, ‘concrete actions’, ‘see the situation from different perspectives’, ‘consensus on how to manage the situation’ and ‘find more courses of action’. Interviewees also perceived improving quality of care, professionalism and the organization as important. Women, nurses, managers and professionals in mentally disabled care rated outcomes more highly than other respondents. Conclusions Dutch healthcare professionals perceived the MCD outcomes related to collaboration as most important. The empirical findings can contribute to shared ownership of MCD and a more specific use of MCD in different contexts. They can inform international comparative research on different CES types and contribute to normative discussions concerning CES outcomes. Future studies should reflect upon important MCD outcomes after having experienced MCD. (shrink)

Finalmente se exponen las conclusiones, y se subraya el tono fundamentalista que el personaje de Creón adquiere en el final de la obra. This article compares the compositional sequences of the Jean Anouilh's Antigone in relation (...) with the homonym Sophoclean play. Convergences and divergent aspects between the protagonists and secondary characters of both plays are analyzed and also the role of the Chorus is mentioned. Finally conclusions are presented, highlighting the fundamentalist tone which Creon acquires at the end of the play. (shrink)

This interdisciplinary study introduces readers to Friedrich Schleiermacher’s diverse pathways of reflection and creative practice that are related to the field of translation. By drawing attention to Schleiermacher’s various writings on a range of subjects (including philology, criticism, hermeneutics, dialectics, rhetoric and religion), the author makes it clear that the frequently cited lecture Über die verschiedenen Methoden des Übersetzens (On the Different Methods of Translating) represents but a fraction of Schleiermacher’s contributions to modern-day insights into translation. The analysis of Schleiermacher’s (...) various pathways of reflection on translation presented in this book leads to the conclusion that translation is part of the essence of the world, as it is a fundamental tool of our cognition and a foundation of our existence. In Schleiermacher’s works, transfer, translation, mediation, and communication underpin our very existence in the world and our self-awareness. At the same time, they represent fundamental categories for a project that focuses on the consolidation and assimilation – through translation – of that which is foreign, different, diverse. Our ability for scientific reasoning is a byproduct of cognitive faculties that evolved in response to problems related to survival and reproduction. Does this observation increase the epistemic standing of science, or should we treat scientific knowledge with suspicion? The conclusions one draws from applying evolutionary theory to scientific beliefs depend to an important extent on the validity of evolutionary arguments (EAs) or evolutionary debunking arguments (EDAs). In this paper we show through an analytical model that cultural transmission of (...) scientific knowledge can lead toward representations that are more truth-approximating or more efficient at solving science-related problems under a broad range of circumstances, even under conditions where human cognitive faculties would be further off the mark than they actually are. Natural theology is the branch of theology and philosophy that attempts to gain knowledge of God through non-revealed sources. In a narrower sense, natural theology is the discipline that presents rational arguments for the existence of God. Given that these arguments rarely directly persuade those who are not convinced by their conclusions, why do they enjoy an enduring appeal? This article examines two reasons for the continuing popularity of natural theological arguments: (i) they appeal to intuitions that humans robustly (...) hold and that emerge early in cognitive development; (ii) they serve an argumentative function by presenting particular religious views as live options. I conclude with observations on the role of natural theology in contemporary analytic philosophy of religion. (shrink)

It is argued, on the basis of new counterexamples, that neither knowledge nor epistemic justification (or “epistemic rationality”) can reasonably be thought to be closed under logical implication. The argument includes an attempt to reconcile the fundamental intuitions of the opposing parties in the debate.

El objetivo de este estudio se plantea, en términos de filosofía jurídica. la siguiente cuestión:¿Cómo debería reaccionar nuestro sistema judicial ante la presencia de otros sistemas regulativos obligatorios para grupos sociales distintos de la mayoría? Previamente el artículo erige un concepto viable de pluralismo cultural evitando los reduccionismos subyacentes: el reduccionismo que identifica pluralismo cultural con el impacto de corrientes migratorias en la Unión Europea; el reduccionismo que deriva del mantenimiento de la imposibilidad de existencia de derechos de grupo; el (...) reduccionismo que considera patológica la diversidad; el reduccionismo que equipara el pluralismo cultural con el pluralismo de valores; etc. Se llega así a la conclusión de que, en primer lugar, la cultura es conflicto, de juicio, y en segundo lugar, que la búsqueda de "una identidad cultural propia'' es un proyecto sin pretensiones. La parte final de este análisis explicita el problema en la Unión Europea y enfrenta las relaciones entre pluralismo y relativismo desde el punto de vista de la Teoría de los Derechos Humanos. Background Q-CEP (Qualificação dos Comitês de Ética em Pesquisa que compõem o Sistema CEP/Conep) is a nationwide project resulting from a partnership between the Brazilian National Research Ethics Commission (Conep), the Ministry of Health and Hospital Moinhos de Vento (HMV). It was developed to consolidate policy for ethical review of research with human beings in all members of the CEP/Conep System, Brazil’s national system of institutional review boards. The aim of this study was therefore to report on the experience and (...) results of the Q-CEP project. Methods An observational, retrospective study includes data from the Q-CEP, obtained from visits to all the institutional research ethics committees (RECs) in the country. The actions implemented by Q-CEP were part of a two-step process: (i) training visits to each REC; (ii) development of distance learning modules on strategic topics pertaining to research ethics evaluation. The data presented herein cover step one (training visits), defined by Q-CEP as the diagnostic stage of the project. For a country with social and economics inequalities such as Brazil, this is a particularly important stage; an accurate picture of reality is needed to inform planning of quality improvement strategies. Results In 2019–2021, Q-CEP visited 832 RECs and trained 11,197 people. This sample covered almost all active RECs in the country; only 4 (0.5%) were not evaluated. Of the 94 items evaluated, 62% did not reach the target of at least 80% compliance and around 1/4 (26%) were below 50% compliance. The diagnostic stage of the process revealed inadequacies on the part of the RECs in their ethical reviews. The analysis of informed consent forms showed compliance in only 131 RECs (15.74%). The description of pending issues made by RECs in their reports was compliant in 19.33% (n = 161). Administrative and operational aspects were also considered inadequate by more than half of the RECs. Conclusions Overall, Brazilian RECs showed poor compliance in several aspects of their operation, both in ethics evaluation and in other processes, which justifies additional training. The Q-CEP project is part of a quality improvement policy promoted by the Brazilian Ministry of Health. The data obtained in the diagnostic step of the project have contributed to the qualification and consolidation of one of the world’s largest research ethics evaluation systems. (shrink)

Arendt, se apoyaban en la imagen de la ciudad hundida. Pero las preguntas sobre (...) el alcance del realismo («puede») y el lugar de los principios («debe») siguen abiertas. ¿Ultra posse nemo obligatur? Aquella imagen de la polis puede ser reemplazada por otra algo distinta, la ciudad sumergida. Se encuentra en la literatura, sería también la metáfora de la necesaria reconstrucción de las políticas democráticas, con el «deber ser» como núcleo de la cultura cívica. Los principios éticos y, en especial, justicia como equidad será aquí la referencia en dos situaciones: (1) la política de salud pública, (2) los procesos de paz. En conclusión, el marco normativo cuenta o ha de contar, tanto en la paz como en la guerra. Decir «nunca más» es también una forma de recordar el papel crucial de los principios. (shrink)

L’A. retrace l’histoire des propriétés individuelles de l’Antiquité et du Moyen Âge à la lumière de la théorie des tropes de D.C. Williams et Campbell. Il insiste sur l’importance de la relation de co-présence et la compare avec des notions apparentées (comme le « syndrome des qualités » ou le « rassemblement des qualités »). L’A. examine également la validité des principes du particularisme ontologique pour la philosophie d’Abélard. Il s’attache à l’examen de la thèse de la non-transférabilité des tropes, (...) chez Boèce, Abélard, et il en rappelle les origines dans l’Islam classique (théologie ash’arite). In current phenomenology of medicine, health is often understood as a state of transparency in which our body refrains from being an object of explicit attention. In this paper, I argue that such an understanding of health unnecessarily presupposes an overly harmonious alignment between subjective and objective body, resulting in the idea that our health remains phenomenologically inaccessible. Alternatively, I suggest that there are many occasions in which one’s body in health does become an object of attention, and that technologies (...) mediate how a relation with one’s body is formed. First, I show prominent accounts in current phenomenology of medicine understand health in terms of a harmonious alignment between objective and subjective body. Second, I argue that there are many occasions in which there is a disharmony between objective and subjective body, and suggest that also in health, we cannot escape being an object that we often relate to. Then, I draw on postphenomenology to show how technologies such as digital self-tracking applications and digital twins can be understood as mediating the relationship with one’s own body in a specific way. In conclusion, I argue that both technologies make present the objective body as a site for hermeneutic inquiry such that it can be interacted with in terms of health parameters. Furthermore, I point to some relevant differences in how different technologies make aspects of our own body phenomenologically present. (shrink)

We were led, at the close of the last paper, to the conclusion that the moral judgment lays claim to a knowledge of what is unknowable. It is not merely that our volition is imperfect, that the act of necessity falls short of what we know to be right. This seems bad enough; but the plight in which we actually find ourselves is even worse. The paradox is that we never know, and never can know, in any particular situation, what (...) it is really right to do. We know indeed that it is always right, really and absolutely right, to do what we believe to be right. For a man to act “against his conscience,” after all possible thought has been taken for its enlightenment, we know to be morally wrong. But this knowledge is purely formal and gives no clue to the matter of moral obligation. It tells us what is common alike to any and every case of moral duty; it does not tell us what we ought to do. For the right that we will cannot be merely the rightness of willing it. What I ought to do cannot be merely that I ought to do it. Now our beliefs and judgments as to material rightness, i.e. as to what it is right to do in a concrete situation, are notoriously liable to error. So we seek for a criterion by which to test our variable and fallible judgments, a criterion of what is really right. But the search is doomed to failure; we can only test beliefs by beliefs, our former beliefs by our later, the beliefs of one man or society or age by those of others. (shrink)

Introducción: el uso de la alimentación enteral en pacientes con demencia resulta un desafío ético-clínico. El objetivo de este artículo es exponer el proceso de validación de un cuestionario para conocer la opinión de los médicos al respecto y sus resultados preliminares. Metodología: se desarrolló un cuestionario anónimo para conocer la opinión de médicos acerca del uso de la alimentación enteral, dirigido a especialistas de cuidados paliativos, geriatría, medicina interna y neurología, de los ámbitos público y privado. Se presentaban allí (...) tres casos clínicos de pacientes con demencia en diferente grado de evolución. Las preguntas abordaban cuatro campos específicos: motivaciones del inicio o suspensión de la alimentación enteral, adecuación terapéutica, eutanasia y toma de decisiones. Resultados: se obtuvo un índice de respuesta del 64 %. El cuestionario resultó una herramienta con validez y fiabilidad aceptables. Los especialistas en cuidados paliativos y geriatría eran más propensos a adecuar el esfuerzo terapéutico y a integrar a la familia en las decisiones. Los profesionales de medicina interna y neurología tendían a ser más invasivos en los tratamientos. Conclusión: los resultados obtenidos permiten recomendar el cuestionario como metodología para valorar la actitud de los profesionales ante las cuestiones bioéticas más relevantes en la atención a pacientes con demencia. El objetivo de este artículo es hacer una reconstrucción racional del uso del examen de proporcionalidad en contextos de adjudicación judicial de derechos sociales constitucionales. Dicho trabajo de reconstrucción será desarrollado en dos pasos. En primer lugar, se tratará el interrogante referido a si el examen de proporcionalidad en su variante “por omisión” exhibe o no una estructura diferente con respecto a su, mucho más conocida e investigada, variante “por exceso”. En segundo lugar, se describirán las reglas y formas de (...) argumentación que están implícitas en el uso del examen de proporcionalidad por omisión y que componen a sus respectivos sub-exámenes de idoneidad, necesidad y proporcionalidad stricto sensu.
